A mother-of-three accused of sleeping with an underage schoolboy walked free from court today when the Crown Prosecution Service failed to produce sufficient evidence for a second trial.

A charge against blonde Tammy Gregory alleged she had climbed into her double bed with the boy and have sex with him.

She maintained her innocence throughout an earlier trial in which she told the court she had only let the teenager sleep in her room because he was extremely drunk and she was worried he would choke on his vomit.

The Crown Prosecution Service had called for a retrial after a jury could not reach a decision on whether the 36-year-old was guilty of having a romp with the 14-year-old boy at a house off the Oxford Road, Reading.

An application in relation to the case was heard at Reading Crown Court today where all charges were dropped due to lack of new evidence. Ms Gregory was not at the hearing.

During the previous trial in March this year, the boy, who cannot be named for legal reasons, had told the court from behind a screen that he had been drinking at Ms Gregory's house and had gone to bed in her room when he awoke to find her next to him and they kissed and had sex.

Giving evidence the accused claimed the boy had turned up at her home  very drunk before being sick on her patio and going to bed. He then wandered into her room saying he felt unwell and she comforted him until he fell asleep.

Mrs Gregory, of Luscinia View, Napier Road, Reading, denied one count of causing or inciting a child to engage in sexual activity.

However, the jury at Reading Crown Court could not agree whether she was guilty or not and told the judge they could not reach even a majority verdict following the three-day trial.

After four hours and 45 minutes deliberation the panel of seven women and five men had returned without a verdict and Mr Recorder Tom Nicholson-Pratt discharged them.
