A FATHER-of-two who burst in on a woman who was sitting on the toilet was cleared of raping her by a jury on Wednesday (October 16).

Denh Ung was acquitted of raping his former colleague, a woman who the manager had interviewed for a job at a global robotics firm.

The jury heard that a group of colleagues went for dinner and drinks but when the bar shut they decided to go to Mr Ung’s hotel room at the Madejski Stadium in Reading to continue drinking.

CCTV footage shown to the jury provided evidence that the junior employee was left alone in Mr Ung’s room for 13 minutes, where the alleged rape took place.

Evidence given by the other colleagues who had been outside the hotel smoking during those minutes stated that their colleague ran outside hysterical and obviously distressed.

She could not speak, she was tearful and shaking.

When asked what was wrong she allegedly responded saying “he put it in me and I did not want it.”

In her closing statement to the jury at Reading Crown Court, defence counsel Nadia Chbat stated that there was no scientific evidence or independent evidence to prove what happened in the hotel room.

In her evidence, the alleged woman victim claimed that she was on the toilet when a naked Mr Ung burst in and exposed himself to her.

She said: “As I was about to pull my trousers up he stood in the doorway completely naked, I felt I was backed into the corner.

“I felt trapped in the room, I walked with my trousers half down and I sat on the edge of the bed. It happened so quickly."

Mr Ung, of Holt Park Drive, Leeds, did not make reference to the bathroom events in his initial police interview with his defence being having had only "two hours sleep".

His updated statement read: “The plan was to stay at the bar in the hotel but it was shut so I said those who wanted too could come to my room.”

The 47-year-old thought they had all left his room to go and smoke when he burst in on his employee.

He said: “I closed my eyes and then went to the loo, undoing my zip. My hand was getting ready to get my penis out when I saw her. I was so embarrassed.

“We were kissing on the lips but I thought she is a valued colleague and I was the manager. I moved my arms away from her and she left. I was alone in my room when I took my clothes off.”

Prosecutor Ahmed Hossain told the jury: “In effect, what Mr Ung is saying is that she has invented a bare-faced lie for some reason. What is being suggested to you is that when the woman says he appeared in the bathroom naked and erect, that is a complete lie.

“Is there any reason you can identify, for a sudden turn in events in that she is leaving the room distressed and immediately reporting that he put his penis in her vagina. The inescapable conclusion is that she is reporting exactly what happened.”

Mr Ung was defended by Ms Chbat and said: “There is no independent evidence in that room and there is no scientific evidence. So you are stuck relying solely on her and his accounts, opposite ends to each other. There is a real danger of unfairness. You have to be sure.

The jury of eight men and four women returned a unanimous "not guilty verdict" in under two hours, acquitting Mr Ung of the charge of rape.
